This Privacy Policy explains what personal data we collect, why we collect it, how we use and protect it, who we may share it with, how long we keep it, and what rights you have.
This Privacy Policy applies to personal data processed by YŌKO Café through our website, YŌKO Unlimited membership, giveaways and promotions, marketing communications, and our use of advertising and tracking technologies.
1. Who is responsible for your personal data?
The data controller responsible for the processing of your personal data is:

In this Privacy Policy, we refer to DUXCHA BV and YŌKO Café as “YŌKO”, “we”, “us” or “our”.

2. What personal data do we process?
The personal data we process depends on how you interact with YŌKO.
YŌKO Unlimited members
If you apply for or use a YŌKO Unlimited membership, we may process:
- your name;
- email address;
- telephone number;
- payment and bank-related information;
- membership start date;
- information necessary to administer your membership; and
- communications relating to your membership.
YŌKO Unlimited membership applications are currently handled by email. Membership payments are made by recurring bank transfer.
Giveaways and promotions
When you enter a YŌKO giveaway or promotion, we may collect information requested in the relevant entry form.
For the YŌKO “Win a Year of Free Drinks” Giveaway, this includes:
- your name;
- email address;
- telephone number;
- town or city; and
- favourite type of drink.
We may also process information necessary to verify that you meet the applicable contest rules. The specific conditions of a giveaway may be described in separate Contest Rules.
Marketing communications
If you actively choose to receive YŌKO news, offers or other marketing communications, we may process:
- your name;
- email address;
- your marketing preferences;
- information about when and how you provided your consent; and
- where technically available, information about your interaction with our communications.
Marketing consent is optional. Where marketing consent is requested in connection with a giveaway or another YŌKO service, you can participate in that service without agreeing to receive marketing communications unless clearly stated otherwise and legally permitted.
Website and advertising data
When you visit our website, certain technical information may be processed automatically. Depending on your cookie and tracking preferences, this may include:
- IP address;
- browser and device information;
- pages or content viewed;
- interactions with our website;
- referral information;
- approximate location derived from technical information;
- cookie and similar identifiers; and
- information about actions taken on our website.
We use Meta advertising technologies, including the Meta Pixel and Meta Conversions API, as further explained below and in our Cookie Policy.
3. Why do we use your personal data?
We process personal data only where we have a valid purpose and legal basis for doing so.
Providing and managing YŌKO Unlimited
We process member data in order to process membership applications, activate and administer memberships, identify members, manage membership payments, communicate about the membership, and provide the services included in YŌKO Unlimited.
Where necessary to provide the membership you requested, this processing is based on the performance of a contract or steps taken at your request before entering into a contract. We may also process certain information where necessary to comply with our legal obligations, including accounting and tax requirements.
Running giveaways and promotions
We process giveaway information in order to register entries, administer the giveaway, verify eligibility and compliance with the applicable Contest Rules, prevent fraud or misuse, randomly select a winner, contact and verify the selected winner, award the prize, and deal with questions or disputes concerning the giveaway.
Depending on the specific processing involved, we rely on the administration of the promotion and our legitimate interests in operating a fair and secure promotion, as well as steps connected with the rules governing participation and awarding the prize. Where we are legally required to retain or process information, we rely on our legal obligations.
Sending marketing communications
Where we ask for your permission to send marketing communications by email, we rely on your consent. Providing this consent is optional. You can withdraw your consent at any time, free of charge. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
Operating and securing our website
We may process limited technical data where necessary to make our website function, maintain the security of our website and systems, detect and prevent fraud or misuse, and diagnose technical problems. Depending on the processing concerned, this may be necessary for the operation of the service, compliance with legal obligations, or our legitimate interests in maintaining a secure and functional website.
Advertising and measurement
Subject to your cookie and tracking choices, we use Meta technologies to understand the effectiveness of our advertising and to measure actions taken on our website after someone interacts with our advertising. Where prior consent is legally required for advertising or tracking technologies, we rely on your consent. 4. YŌKO giveaways
When we organise a giveaway, the personal data provided through the entry form is used for the administration of that specific giveaway.
Providing the information identified as mandatory in the entry form is necessary to participate. If you do not provide the required information, we may not be able to register your entry or award you a prize.
Giving permission to receive marketing communications is not required to participate in a giveaway, unless explicitly stated otherwise where legally permitted.
For the “Win a Year of Free Drinks” Giveaway, personal data collected specifically for the administration of the giveaway will normally be retained for up to three months after the end of the Giveaway.
We may retain specific information for longer where this is reasonably necessary to comply with a legal obligation, resolve a dispute, prevent or investigate fraud, or establish, exercise or defend a legal claim.
If you separately opted in to YŌKO marketing communications, the contact information processed for that separate purpose may continue to be retained after the giveaway data is deleted.
5. Marketing
We may offer you the opportunity to receive YŌKO Café and YŌKO Unlimited news, offers and updates by email.
Where we rely on consent, we will ask you to make an active choice. Marketing consent will not be assumed simply because you visit our website, purchase or use a service, or participate in a giveaway.
You can withdraw your consent at any time. Where available, you can do this by using the unsubscribe option in a marketing email. You can also contact us at info@yokocafe.be.
After you unsubscribe, we may retain limited information necessary to record your opt-out and ensure that we respect it.
8. International transfers
Some of the service providers we use, including Google and Meta, are international organisations and may process personal data outside Belgium or the European Economic Area (“EEA”).
Where personal data is transferred outside the EEA, we aim to ensure that an appropriate legal transfer mechanism or safeguard is in place as required under applicable data protection law. Depending on the recipient and destination, this may include an adequacy decision adopted by the European Commission or appropriate contractual safeguards.
9. How long do we keep your personal data?
We do not intend to keep personal data for longer than necessary for the purpose for which it was collected. As a general principle:
- Giveaway data is normally retained for up to three months after the relevant giveaway ends, unless a longer period is reasonably required for legal or dispute-related purposes.
- Marketing data is retained while your marketing consent remains valid or until you withdraw your consent, subject to limited retention where necessary to record and respect your opt-out.
- YŌKO Unlimited membership data is retained while your membership is active. When the membership ends, information that is no longer required will be deleted or anonymised within a reasonable period.
- Accounting, transaction and payment-related records may be retained for longer where necessary to comply with applicable Belgian accounting, tax or other legal retention obligations.
- Technical and security information is retained only for as long as reasonably necessary for the relevant security, operational or legal purpose.
Where possible, data that is no longer required will be deleted or anonymised.
10. How do we protect your personal data?
We take reasonable technical and organisational measures designed to protect personal data against unauthorised access, accidental loss, misuse, alteration, disclosure and destruction.
Access to personal data is limited to persons and service providers who reasonably require access for the purposes described in this Privacy Policy. However, no electronic transmission or storage system can be guaranteed to be completely secure.
11. Your data protection rights
Under applicable data protection law, including the General Data Protection Regulation (“GDPR”), you may have the right to:
- access the personal data we hold about you;
- ask us to correct inaccurate or incomplete personal data;
- ask us to delete your personal data in certain circumstances;
- ask us to restrict certain processing;
- object to processing based on legitimate interests in certain circumstances;
- receive certain personal data in a structured, commonly used and machine-readable format and request data portability where applicable;
- withdraw your consent at any time where processing is based on consent; and
- lodge a complaint with a supervisory authority.

You also have the right to lodge a complaint with the competent data protection supervisory authority. In Belgium, this is the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données).
13. Children
Our Giveaway described above is restricted to persons aged 18 or older. We do not knowingly use the Giveaway to collect personal data from persons under the applicable minimum participation age.
If we become aware that personal data has been provided in violation of an applicable age restriction, we may delete that information.
14. Third-party websites and platforms
Our website and communications may contain links to external websites or platforms, including Instagram and other Meta services.
Those services operate under their own privacy policies and terms. YŌKO is not responsible for the privacy practices of third-party websites or platforms that we do not control. We recommend reviewing the privacy information provided by those third parties before providing them with personal data.
15. Changes to this Privacy Policy
We may update this Privacy Policy when our services, technologies or data-processing activities change or when this is necessary to reflect changes in applicable law.
The latest version will be made available on our website. Where changes materially affect the way we process your personal data, we will take reasonable steps to inform you where required. The “Last updated” date at the top of this Privacy Policy indicates when it was most recently revised.
